成分特許を認めていないインドなど特許制度が欧米と異なる国では特許が切れた薬ではなく、インドの国内法において特許が認められてない、特許の適用から外れている薬がジェネリック医薬品として大量に生産されており、アフリカなどの貧困国ではインド製のジェネリック医薬品が大量に使用されている。 エイズ治療薬ネビラピンなど欧米では特許が切れていないためにジェネリックが生産されていないのに、インドでは特許が無効なために大量のジェネリックが生産されエイズに悩むアフリカ諸国で大量に使用されている現状がある。 この問題は欧米との間で争いになっており、欧米側が新しい法律を作って規制するなど対抗措置を行っているが、インド製の安いジェネリック医薬品が途絶えれば貧困国の医療が崩壊するという深刻な問題も孕んでいる。
